Missouri Attorney General Hanaway files lawsuit against U.S. Department of Commerce and Census Bureau

MISSOURI (KFVS) - Missouri Attorney General Catherine Hanaway filed a lawsuit against the U.S. Department of Commerce and the Census Bureau, requesting a Census recount, excluding undocumented immigrants.

According to the Missouri Attorney General’s Office, Hanaway demands a Census recount and for the Court to “prohibit the inclusion of illegal aliens in the Census.”

Hanaway said, “United States citizens and lawful permanent residents have a right to representation, unlike illegal aliens and temporary visa holders.”

The complaint was filed on Friday, January 30.

Hanaway’s complaint made to the United States District Court for the Eastern District of Missouri requests:

  • A declaration that including undocumented immigrants and temporary visa holders in the 2020 Census and the 2021 Apportionment was unconstitutional
  • A redo of the 2020 Census and 2021 Apportionment, excluding undocumented immigrants
  • Prohibiting the Census Bureau from including undocumented immigrants and temporary visa holders in the 2030 Census
